Terms of Sale & Limited Warranty
1. General "As-Is" Provision
All products sold by Greenhouse Pets and Plants, including but not limited to fertilizers, soils, substrates, and pet food, are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Greenhouse Pets and Plants disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
2. Growing Supplies and Hardware
Greenhouse Pets and Plants does not provide an independent warranty for manufactured hardware, lighting systems, or mechanical growing supplies.
- Manufacturer Warranty: These items are covered solely by the original manufacturer’s warranty. Customers are encouraged to register their products with the manufacturer upon receipt.
- Technical Support: All claims for defects, malfunctions, or repairs must be directed to the manufacturer. Greenhouse Pets and Plants may, at its discretion, assist in providing manufacturer contact information but is not responsible for repair or replacement costs.
3. Fertilizers, Soils, and Substrates
The customer acknowledges that agricultural and horticultural success depends on variables beyond the Company’s control.
- No Guarantee of Results: We do not warrant or guarantee any specific plant health, growth rates, or crop yields.
- Application and Storage: Greenhouse Pets and Plants is not liable for "nutrient burn," crop failure, or soil contamination resulting from over-application, improper mixing, or incorrect storage (e.g., exposure to extreme temperatures or moisture) of these products by the customer.
4. Raw Pet Food and Consumables
Due to the highly perishable nature of raw pet food and treats, the following terms apply:
- Quality Assurance: We warrant that all pet food is sold within the manufacturer’s "Best By" date and has been maintained under strict temperature controls while in our possession.
- Transfer of Risk: Greenhouse Pets and Plants is not responsible for spoilage, bacterial growth, or degradation of food products once they have left our facility or have been confirmed as delivered.
- Handling & Sensitivities: The customer assumes all risk regarding proper home storage (freezing/thawing) and pet-specific adverse reactions, allergies, or dietary sensitivities.
5. Shipping, Delivery, and Local Pickup
- Frozen Goods: For shipped orders containing frozen pet food, the customer is responsible for being present at the time of delivery to ensure items are immediately transferred to appropriate storage.
- Damaged Shipments: Any claims for items damaged in transit must be reported within 24 hours of receipt, accompanied by photographic evidence of the packaging and product.
- Local Pickup: Items not picked up within 14 days of notification may be subject to a restocking fee or cancellation without a refund for perishable goods.
6. Returns and Exchanges
- Non-Returnable Items: For safety and bio-security reasons, we cannot accept returns on opened fertilizers, soils, or any perishable pet food products.
- Hardware Returns: Unopened hardware in original packaging may be returned within 7 days, subject to a restocking fee. Shipping costs for returns are the responsibility of the customer.
7. Limitation of Liability
In no event shall Greenhouse Pets and Plants, its directors, or employees be liable for any direct, indirect, incidental, or consequential damages arising from the use of our products. This includes, but is not limited to, the loss of plant life, equipment damage, or veterinary expenses. Our total liability is strictly limited to the original purchase price of the specific item in question.
8. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada. Any disputes arising from these terms shall be resolved in the courts of Victoria, BC.
